Delhi HC to Pronounce Order on Kuldeep Singh Sengar’s Bail Plea in Custodial Death Case Today

The Delhi High Court is set to pronounce its order on the suspension of sentence (bail plea) of former BJP MLA Kuldeep Singh Sengar in the Unnao custodial death case on Tuesday. Justice Ravinder Dudeja will deliver the judgment at 2:30 pm. The court had reserved its verdict on November 6.

Sengar has been in custody since April 13, 2018, and is serving a 10-year prison sentence in the custodial death case of the Unnao rape victim’s father. He is also serving a life sentence in a separate minor rape case.

Earlier, Sengar was granted bail in the minor rape case on December 23, 2025. However, the Supreme Court stayed that order on December 29.

Opposing the bail plea, Advocate Mehmood Pracha, appearing for the rape victim, argued that Sengar does not deserve bail as there continues to be a threat to the victim and her family. He submitted that the victim is being harassed and defamed on social media through false allegations.

On the other hand, senior advocate Manish Vasisth, along with advocate Kanhaiya Singhal, appeared for Sengar and contested the arguments of the victim’s counsel. They submitted that Sengar has already spent nearly nine years in custody in the custodial death case and has only about 11 months of his sentence remaining.

Sengar’s counsel further argued that he was not present at the site of the incident on April 3, 2018. It was also contended that the trial court relied on statements under Section 61 of the CrPC involving Sengar’s secretary, Santosh Mishra, who allegedly spoke to the appellant on the phone on the day of the incident. However, Mishra was not examined as a witness during the trial.

The defence also pointed out alleged contradictions in the statements of two prosecution witnesses, questioning their credibility and reliability.

Sengar, along with other accused, was convicted by the Tis Hazari Court in 2018. The cases arose from FIRs registered in 2018 at Makhi Police Station in Unnao, Uttar Pradesh, and were adjudicated by the District and Sessions Judge (West) at Tis Hazari Courts, Delhi.

The defence further submitted that Sengar had been granted an interim suspension of sentence earlier for his daughter’s marriage and had not misused the liberty granted to him during that period.
